Change Order
This quote, once signed, is a final order. Any changes made after acceptance and before the event start date or equipment leaves ACR facilities will be billed at an additional cost, including any labor required due to changes. All changes must be documented and approved in writing, including electronic communications. Any cancellations after equipment leaves our facilities will remain invoiced at full cost.Payment Terms
• All productions require a 50% deposit no later than 30 days prior to the event start date. Failure to provide the deposit by this deadline may result in forfeiture of the reservation.
• Payment by credit card incurs a service charge of 3.5% of the total order amount.
• Late payments are subject to a fee of 1.5% per month on the outstanding balance.Liability
• The Client is responsible for loss, theft, or damage to any personnel or rental equipment during the term of this contract, excluding damages caused solely by ACR Productions’ negligence or equipment malfunction.
• The Client will be billed for repairs or replacements, including parts and accessories.
• The Client agrees to provide security for ACR Productions while onsite for the event, including during load-in, strike, and any periods when equipment is not in use.
• Secure, lockable storage must be provided onsite at no cost to ACR Productions for storing cases, extra equipment, etc.Cancellation Terms
• Notice of Cancellation: All cancellations must be submitted in writing to ACR Productions. A cancellation is deemed effective upon receipt of written notice by ACR Productions.Cancellation Fees:
• Cancellations made more than 30 days prior to the event start date are subject to a 10% administrative fee of the overall invoiced amount.
• Cancellations made between 30 and 7 days prior to the event start date are subject to a 50% charge of the overall invoiced amount.
• Cancellations within 7 days or less of the event start date are subject to a 100% charge of the overall invoiced amount.
• Exceptional Circumstances: Requests for exceptions to the cancellation policy due to extraordinary circumstances will be reviewed on a case-by-case basis. ACR Productions reserves the right to make the final determination.
• Force Majeure: Cancellations due to events outlined in the Force Majeure clause are subject to its terms and do not qualify for refunds but may apply toward future events.Force Majeure
• If the contract becomes impossible to perform due to acts of God, war, government regulations, disasters, pandemic, strikes, civil disorder, curtailment of transportation, or other emergencies making it illegal or impossible to provide services, this contract may be terminated with written notice.
• This applies to conditions in the contracted city or immediate surrounding area within 10 days prior to the event start date.
• Deposited funds will be applied toward future events and will not be refunded.Weather Terms
• The Client assumes all risks associated with outdoor events, including rain, wind, and other adverse weather conditions.
• The Client must provide appropriate tents or structures to minimize weather risks. Rain or wind cancellations are subject to the stated cancellation policies.
• If the event location changes due to weather, additional equipment and labor charges may apply.Other Responsibilities
• The Client must provide water, refreshments, and meals for ACR Productions crew for all event days, including load-in, set-up, show days, and strike. If not provided, meals will be billed additionally.
• Lodging must be provided for multi-day and/or out-of-town events.
• Parking for ACR Productions crew, including trucks and personal vehicles, must be provided and paid for by The Client.
• The Client is responsible for any venue-associated fees, including utilities or connection fees.Technical Specifications
• ACR Productions reserves the right to adjust technical specifications based on actual event needs and venue requirements. Any necessary additions will be billed at full market rate.
• The Client will be notified of any changes and must approve additional costs before implementation.Insurance Requirements
ACR Productions is fully insured with workers' compensation and limited liability insurance and can provide a Certificate of Insurance (COI) upon The Client's request.Indemnification
The Client agrees to indemnify and hold ACR Productions harmless from any third-party claims arising from the event.Georgia Law
This contract is governed by the laws of the State of Georgia.Dispute Resolution
Any disputes arising from this contract will first be subject to mediation. If unresolved, the matter will proceed to arbitration in accordance with Georgia state laws.
